What is Medical Malpractice?

When a physician or other health care provider fails to do something that should have been done, or does something that should not have been done, which results in death or injury, that is "medical malpractice" or "medical negligence".

Examples of Medical Malpractice Include:

  • Delayed Cancer Diagnosis
  • Wrongful Death
  • Paralysis
  • Amputation
  • Birth Trauma
  • Brain Injured Infants
  • Inappropriate or Negligently Performed Surgery
  • Misdiagnosis of Disease or Injury
  • Disability
  • Disfigurement

If any health care provider fails to act as a "reasonably competent physician, surgeon or health care provider would in the same or similar circumstances in the diagnosis or treatment of a patient", malpractice occurs.
